These Terms of Service ("Terms") govern your access to and use of the iGig platform at igig.co.ke and related services (the "Platform"), operated by Unique Brand Creatives, a business registered in Kenya (registration no. PVT-V7UYK9R5) with its registered office at P.O. Box 87–30100, Eldoret, Uasin Gishu, Kenya ("iGig", "we", "us"). By creating an account, accessing, or using the Platform you agree to these Terms. If you do not agree, do not use the Platform.
1. Definitions
- Client / Buyer — a user who purchases or commissions services.
- Freelancer / Seller / Talent — a user who offers and delivers services.
- Job Seeker — a user who maintains a private resume profile for review readiness.
- Order — a purchase of a service/package placed through the Platform.
- Platform Fees — commissions and fees described in clause 6.
2. The Platform's role (intermediary)
iGig is a venue and intermediary that enables Clients and Freelancers to find each other, agree on, pay for, and manage services. iGig is not a party to the contract for services formed between a Client and a Freelancer, is not the employer, agent, or partner of any user, and does not perform, supervise, or guarantee the services. The contract for each Order is directly between the Client and the Freelancer. iGig does not provide legal, financial, employment, or tax advice.
3. Eligibility & accounts
3.1 You must be at least 18 years old and able to form a binding contract. 3.2 You must provide accurate information and keep it current. You are responsible for all activity under your account and for safeguarding your credentials. 3.3 One person or entity may hold the account modes the Platform offers (e.g. Client, Freelancer, Job Seeker, Employer). You must not impersonate others or create accounts to evade suspension. 3.4 We may verify identity (see clause 9) and may suspend, limit, or close accounts that breach these Terms or applicable law.
4. User obligations
You agree not to:
- post false, misleading, infringing, unlawful, or harmful content;
- transact outside the Platform to avoid Platform Fees (see clause 6.4);
- circumvent, disable, or interfere with security, payments, or fees;
- harvest data, scrape, or use the Platform to build a competing dataset;
- use the Platform for money laundering, fraud, or any unlawful purpose. Detailed conduct rules are in the Acceptable Use Policy, which forms part of these Terms.
5. Services, orders & delivery
5.1 Freelancers are solely responsible for the accuracy of their listings, pricing, scope, deliverables, timelines, and for delivering lawful work they have the right to provide. 5.2 Clients are responsible for providing accurate briefs and for reviewing deliverables promptly. 5.3 Order states, revisions, messaging, and completion are managed through the Platform. Marking an Order complete (or the lapse of any auto-completion window, if enabled) authorises release of funds to the Freelancer, subject to clause 7 and the Refund & Dispute Policy.
6. Fees, payments & taxes
6.1 Platform commission. iGig charges a commission of 7% on Orders and/or the fees described on the pricing and membership pages. Fees are shown before you confirm. 6.2 Payments. Payments are processed by third-party providers (e.g. M-Pesa/Co-op STK, Paystack, Flutterwave, and others as enabled). By paying, you also accept the relevant provider's terms. Amounts are in Kenyan Shillings (KES) unless stated otherwise. 6.3 Fund handling & payouts. Funds for an Order are held by the Platform and released to the Freelancer's balance after the Order is completed, less Platform Fees. Freelancers may request withdrawals subject to minimum/maximum limits, processing charges, verification, anti-fraud controls, and admin approval. iGig does not pay interest on held balances. 6.4 No off-platform circumvention. Soliciting or arranging payment outside the Platform to avoid fees is prohibited and may result in account closure and forfeiture of pending balances to the extent permitted by law. 6.5 Taxes. Each user is responsible for determining and meeting their own tax obligations (including any income tax, VAT/Digital Service Tax, or withholding) arising from their use of the Platform. iGig may collect tax information and withhold or remit taxes where required by law. iGig (Unique Brand Creatives, KRA PIN P052109565I) is not currently registered for VAT; prices do not include VAT. If iGig becomes VAT-registered, applicable VAT will be shown and charged from that date.
7. Disputes between users
7.1 Clients and Freelancers should first try to resolve issues directly through Order messaging and revisions. 7.2 If unresolved, either party may raise a dispute through the Platform. iGig may, at its discretion and acting reasonably, review the Order, communications, and evidence and decide an outcome (including release, partial release, or refund of held funds). The Refund & Dispute Policy governs this process. 7.3 iGig's dispute decisions relate only to Platform-held funds; they are not legal determinations and do not limit the parties' rights to pursue other remedies.
8. Content & intellectual property
8.1 Your content. You retain ownership of content you submit. You grant iGig a worldwide, non-exclusive, royalty-free licence to host, display, and use it as needed to operate and promote the Platform. 8.2 Deliverables. IP ownership of work delivered in an Order is as agreed between Client and Freelancer; absent agreement, ownership of the final deliverables transfers to the Client on full payment for the Order, and the Freelancer retains ownership of any pre-existing materials and general know-how used to produce them. 8.3 Platform IP. The Platform, its software, branding, and content (excluding user content) belong to iGig or its licensors. No rights are granted except as expressly stated. 8.4 Infringement. We respond to valid infringement complaints and may remove content and terminate repeat infringers. Send notices to hello@igig.co.ke.
9. Verification, reviews & ratings
9.1 We may offer identity/business verification and a "verified" badge. Verification is a limited check, not a guarantee of a user's identity, quality, legality, or conduct. 9.2 Reviews and ratings must be genuine and based on real transactions. Manipulating reviews is prohibited. iGig may remove content that violates these Terms.
10. Suspension & termination
10.1 You may close your account at any time; obligations accrued before closure survive. 10.2 We may suspend or terminate access immediately for breach, suspected fraud, legal risk, or to protect users or the Platform. Where lawful and practical we will give notice and reason. 10.3 On termination, eligible balances are paid out subject to verification, fees, holds for disputes/chargebacks, and applicable law.
11. Disclaimers
The Platform is provided "as is" and "as available". To the maximum extent permitted by law, iGig disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. iGig does not warrant that listings, users, services, or deliverables are accurate, lawful, safe, or of any quality, or that the Platform will be uninterrupted or error-free.
12. Limitation of liability
To the maximum extent permitted by Kenyan law: iGig is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, data, or goodwill; and iGig's total aggregate liability arising out of or relating to the Platform is limited to the total Platform Fees you paid to iGig in the 6 months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.
13. Indemnity
You will indemnify and hold harmless iGig and its officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Platform, your services or deliverables, or your breach of these Terms or law.
14. Changes
We may update these Terms. Material changes will be notified (e.g. by notice on the Platform or email). Continued use after the effective date constitutes acceptance. The current version is always available on the Platform.
15. Governing law & dispute resolution
These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute arising out of or relating to them.
